Gov. Josh Shapiro's Aug. 18 order ties Pennsylvania data center permits, a key sales tax break, and grid curtailment priority to new energy, siting, workforce, and community standards.
Pennsylvania just made large data centers pay for the grid they load, or not build. Governor Josh Shapiro's Executive Order 2026-05, signed Aug. 18, re-prices who bears the cost of AI compute's externalities by attaching strings to state permits, a signature tax break, and the order in which the regional grid operator curtails power when supply gets tight.
The order draws a line at peak demand above 25 megawatts, roughly the peak demand of a small city. Data center projects above that threshold are immediately out of Pennsylvania's PA Permit Fast Track Program, the state's coordinated permitting lane. They are also now subject to four state levers at once: the tax break, the permit track, utility regulation, and nondisclosure limits.
Pennsylvania offers a Computer Data Center Equipment sales and use tax exemption, and Shapiro's order directs the Department of Revenue to require applicants to comply with the Governor's Responsible Infrastructure Development (GRID) requirements before they can claim it. The GRID standards, first released in May as conditions for state project assistance, cover energy, infrastructure, environment, workforce, and community obligations. They were previously a way to unlock coordinated state help. Under the order, they are now the test for the tax break itself.
The order also restricts state agencies from entering nondisclosure agreements on data center projects, ending a recurring friction point with local officials and ratepayer advocates who said opacity let projects lock in commitments before the public could see the terms.
The grid lever is the one that goes beyond Pennsylvania's borders. Shapiro's Special Counsel for Energy Affordability is directed to press the Pennsylvania Public Utility Commission (PUC), the state's utility regulator, to curtail data centers ahead of other customers during certain grid emergencies unless the project has secured incremental capacity for its full demand; to prevent data centers from receiving critical-load exemptions from curtailment; and to assign them costs tied to PJM Interconnection, the regional grid operator covering Pennsylvania and most of the mid-Atlantic, and to PJM reliability measures. In practice, that means a hyperscale build in central Pennsylvania would pay for the transmission upgrades its load triggers rather than spreading them across residential and small-commercial ratepayers.
"Starting today, AI data center developers who want to do business in our Commonwealth must respect our communities and abide by these stringent requirements," he said at the signing, adding: "I want to be clear: these are not voluntary standards, they are legally-binding requirements to operate here in the Commonwealth." His office said the order is intended to "weed out speculative proposals and hold bad actors accountable for their attempts to run roughshod over Pennsylvania communities."
The practical question is whether the template travels. Pennsylvania is the first state inside PJM, the regional grid where the ratepayer-versus-data-center debate is concentrated, to put binding conditions across permits, tax, and utility regulation at once. Other PJM states, including Virginia, Maryland, New Jersey, and Ohio, face the same load growth and the same allocation fight. The order gives them a copyable structure: a threshold, a tax-break gate, a curtailment priority, and a PJM cost-assignment rule.
The binding-versus-voluntary shift is the part other states will study most closely. The GRID framework was a way to unlock state help, not a gate on a tax break that, for many large projects, materially changes build economics. Pennsylvania is now the first to convert that framework from a benefit to a precondition.
The first PUC order on curtailment will tell other PJM states whether Pennsylvania's four-lever structure survives a test, or whether projects reroute to states without a binding GRID.
