This week, the federal government moved on two parallel tracks to make AI data centers pay for the grid infrastructure they consume.
The Federal Energy Regulatory Commission (FERC) voted unanimously to order AI data centers and other large power users to connect to the transmission system "in a timely and orderly manner," with the data centers themselves paying the full cost of any grid upgrades their connections require, according to MyNorthwest's reporting on the order. Days earlier, Rep. Michael Baumgartner, a first-term Republican from eastern Washington's 5th District, introduced H.R. 9419, the Power and Water for Families Act of 2026, Seattle Red reported. The bill would require large electricity users to cover the full incremental cost of generation, transmission, and distribution upgrades built to serve them, paired with tax credits for water reuse and on-site recycling.
Different levers, same destination. A single hyperscale data center can draw power on the scale of a small city, and the new transmission lines, substations, and generation capacity built for one campus are typically socialized across households and small businesses on the same utility. Both FERC's order and H.R. 9419 target that cost-shift, the grievance Seattle Red has branded as the "off your tab" problem and that has driven local pushback across Washington state from Seattle to Spokane.
The Baumgartner bill is freshly introduced, reported locally the week of June 22, 2026 by KHQ, so committee referral, cosponsors, and floor prospects are not yet established. Baumgartner himself joined the House in January 2025 and sits on the Education and Workforce, Foreign Affairs, and Judiciary committees, a portfolio that does not naturally position him as an energy-policy author. That makes the bill less a personal crusade than a translation of a regulatory mood already in motion at FERC into a statutory form a Republican freshman can attach his name to.
In parallel, several major AI and cloud companies — including xAI, Google, Microsoft, Meta, Oracle, OpenAI, and Amazon — have signed the Trump administration's voluntary Ratepayer Protection Pledge, committing to shoulder grid costs in states where they build. FERC's order and Baumgartner's bill exist in parallel with that voluntary effort, and the question now is whether such commitments harden into binding rules before the next wave of campus announcements.
The local backdrop helps explain the political temperature. Seattle's city council passed an emergency data-center moratorium and policy framework on June 9, 2026, weeks after introducing the pause on April 30 and unanimously voting to halt new data centers. Spokane, Baumgartner's home turf, has imposed a one-year moratorium on data centers inside city limits. These are municipal zoning actions, not direct outcomes of either federal bill, but they are the political-pressure backdrop that makes cost-causer-pays legislation politically saleable.
There is also a Democratic counterpoint moving through the Washington state legislature that converges on the same economic principle. HB 2515, carried by Rep. Beth Doglio, shifts grid-connection and system-upgrade costs onto data centers and layers a 100% clean-electricity-by-2036 requirement on top. The two bills disagree on energy mix and on venue, but they agree on who pays for the wires.
The narrow question now is whether the federal cost-causer-pays language gets defined precisely enough to bind. FERC's order is already in effect at the regulatory level. The statute, if it moves, would write the same principle into federal law and reach cases the regulator cannot.
