The European Union is preparing to label ChatGPT and Roblox as "very large online platforms" under the Digital Services Act, the bloc's central rulebook for content, ads, and dark-pattern design, according to a Bloomberg report carried by Gizmodo. The move would extend a regime built in 2023 around feed-style services like Facebook, Instagram, TikTok, and YouTube to an AI assistant and a child-facing gaming platform for the first time.
VLOP designation kicks in at 45 million EU-based monthly users. Once on the list, a service gets Commission audit access, binding rules on content moderation and deceptive design, and an annual fee capped at 0.05% of the provider's worldwide profit. The Commission's current VLOP list already names Amazon Store, TikTok, Wikipedia, YouTube, Facebook, Instagram, LinkedIn, and Zalando.
The European Commission declined to comment. OpenAI and Roblox did not respond to Bloomberg's request for comment as of Gizmodo's write-up. OpenAI has nonetheless published a public DSA explainer that signals awareness of the regime.
The most visible DSA fine so far is the roughly $140 million against X, formerly Twitter, which the company is appealing. If the new designation is confirmed, it would shift the list's center of gravity from 2010s feed platforms to 2020s AI assistants and gaming sandboxes.
